In this document, DAFI DITION SRL may be referred to as “we” or the “Company,” while the services provided will be referred to as the “Platform” or “Linkyfix Services.”

1. General Overview and Acceptance

1.1. Purpose and Scope The linkyfix.eu platform provides link-shortening and customization features (URLs), link-in-bio generation, traffic analysis tools, and other related services (collectively referred to as the “Linkyfix Services”).

1.2. Acceptance of the Terms and Conditions By accessing, creating an account, or using any part of the Linkyfix Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use the linkyfix.eu platform.

1.3. Changes to the Terms We may update these Terms to reflect legal changes, improvements to the Platform, or other relevant reasons. If significant changes are made, we will notify you by email or a prominent notice on the site at least 30 days before such changes become effective. Continuing to use the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the new provisions, please close your account and discontinue use of the Linkyfix services.

2. Creating and Managing Your Account

2.1. Eligibility

  • You may use the Linkyfix Services only if you are at least 18 years old (or have reached the age of majority in your jurisdiction).
  • If you use Linkyfix on behalf of a company or any other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2.2. Accurate and Up-to-Date Information

  • You are responsible for providing correct and complete information when registering your account (name, email address, etc.).
  • If your information changes, please update it so that you can receive notifications and maintain uninterrupted access to your account.

2.3. Account Security

  • Keep your login credentials (email, password) confidential.
  • All actions taken through your account will be deemed to have been made by you. If you suspect unauthorized use of your account, please contact us immediately.

2.4. Username and Subdomains

  • You may choose a username and/or a personalized subdomain, as long as they do not infringe the intellectual property rights of others and are not offensive or misleading.
  • The Company reserves the right to request a change or to deactivate any username/subdomain that violates the law or third-party rights, or that does not comply with our internal rules.

3. Plans, Subscriptions, and Payments

3.1. Types of Plans

  • Linkyfix may offer a free plan (Free) and one or more paid plans (e.g., Pro, Business).
  • Details (included features, pricing, fees) are available on the pricing page of the website.

3.2. Subscriptions and Costs

  • If you choose a paid plan, you will be charged according to the plan you selected (monthly, annually, etc.).
  • Prices may or may not include VAT or other applicable taxes, depending on the legislation in force.
  • The Company may change prices and will send you a notification 30 days before new fees come into effect.

3.3. Automatic Renewal

  • Paid subscriptions automatically renew at the end of each billing period, unless you cancel before the renewal date.
  • If the renewal charge cannot be processed (expired card, etc.), we may suspend, cancel your subscription, or downgrade your plan to free.

3.4. Cancellation and Refund Policy

  • You can cancel a paid subscription at any time. However, the services remain active until the end of the already paid billing period.
  • Payments made are generally nonrefundable. However, in exceptional cases (e.g., requests within the first 72 hours), we may grant a partial or full refund at our discretion.
  • If the subscription was purchased through an app store (Apple Store, Google Play), any refund will be managed according to the policies of those third-party providers.

4. Content Rights and Obligations

4.1. Your Content “Content” refers to any text, image, file, video, link, etc. that you post, upload, or display through the Platform. You are fully responsible for its legality and for securing all the necessary licenses and rights to publish it.

4.2. Content Restrictions

  • Your content must not be illegal, defamatory, threatening, discriminatory, harmful, or fraudulent.
  • You may not include scripts, bots, or other automated data-collection methods that interfere with the operation of the Platform or other users.
  • You are prohibited from posting links to content that infringes any copyright, trademark, or other intellectual property rights of third parties.

4.3. License Granted to Us By posting your Content on the Platform, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, modify, and create derivative works of your Content, but only for the purpose of providing, promoting, and improving the Linkyfix Services.

4.4. Content Monitoring and Removal

  • We are not obligated to constantly monitor user-uploaded Content but reserve the right to review and remove it if it violates these Terms or the law.
  • We may suspend or terminate the accounts of users who repeatedly infringe intellectual property rights.

5. Third Parties, External Links, and Monetization

5.1. Links to Third Parties

  • The Linkyfix Services allow you to shorten and share links to external sites beyond our control.
  • We accept no liability for the content of such sites or any damage that may result from accessing them.

5.2. Integration with Payment Solutions and Other Services

  • If we use third-party services (e.g., payment processors, email marketing solutions, social media integrations), those parties’ terms and conditions also apply, and you must comply with them.
  • We do not assume responsibility for issues, additional fees, errors, or nonconformities arising from your relationship with third parties.

5.3. Monetization and Commissions

  • We may offer monetization options (e.g., donations, product sales, affiliate commissions). These services may be subject to fees and/or additional terms.
  • You are responsible for complying with legal provisions regarding taxes, fees, and financial obligations in relation to tax authorities.

6. Suspension and Account Termination

6.1. Termination at Your Initiative

  • You may stop using the Linkyfix Services at any time by canceling your subscription (if applicable) and/or requesting account closure.
  • If you have a paid subscription and cancel it, you can continue to use the plan’s features until the end of the already paid billing period.

6.2. Suspension or Termination by Us

  • We may suspend or terminate your account if you violate these Terms, if we receive legal requests to do so, if we detect fraudulent activities, or if you fail to pay due fees.
  • We will not be liable for any damage or data loss caused by account termination, nor will we refund any amounts paid except as permitted by these Terms or by law.

7. Intellectual Property Rights

7.1. Company Rights

  • The Platform, source code, design, texts, images, logos, and all elements that make up the Linkyfix Services (except for user Content) are the exclusive property of DAFI DITION SRL or its licensors.
  • You may not copy, modify, distribute, sell, or create derivative works from our content (other than your own Content) without our prior written consent.

7.2. Limited License

  • We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform solely for the benefits provided by the Linkyfix Services.
  • You are prohibited from decompiling, reverse-engineering, extracting source code, or otherwise exploiting our intellectual property in any unauthorized manner.

8. Data Protection and Privacy

8.1. Privacy Policy The processing of personal data is carried out in accordance with our Privacy Policy, which is an integral part of these Terms. Please read it carefully to understand how we protect your data.

8.2. Visitor Data

  • If you use linkyfix.eu to generate shortened links or link-in-bio pages, we may collect and display traffic data related to your links.
  • You are responsible for informing your own visitors/subscribers about your privacy and cookie policies, where required by law.

9. Limitation of Liability

9.1. Services Provided “As Is” The Linkyfix Services are provided “as is,” without any express or implied warranties regarding performance, reliability, availability, or suitability for a particular purpose.

9.2. Exclusion of Certain Damages We shall not be liable for any indirect, special, incidental, punitive, or consequential damages (e.g., lost profits, data loss, business interruption).

9.3. Maximum Liability To the fullest extent permitted by law, our total liability to you shall not exceed the amount you paid us in the 12 months preceding the event that gave rise to the liability claim or, if you do not have a paid subscription, the amount of USD 100 (or the equivalent in local currency).

10. Indemnification

You agree to indemnify and hold us (including our employees, affiliates, and representatives) harmless from any claims, demands, damages, costs (including attorneys’ fees) that arise from or relate to:

  • Your breach of these Terms;
  • Your violation of the rights or legitimate interests of third parties;
  • Any illegal or unlawful activities carried out through your account.

11. Governing Law and Dispute Resolution

These Terms are governed by Romanian law. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If an amicable resolution cannot be reached, the dispute shall be settled by the competent courts in Romania.

12. Force Majeure

We will not be liable for failure or delay in performing our obligations for reasons beyond our reasonable control (force majeure, natural disasters, war, civil conflicts, unavailability of communication networks, etc.).

13. Miscellaneous

13.1. Entire Agreement These Terms, along with the Privacy Policy and any other mentioned policies, constitute the entire agreement between you and DAFI DITION SRL regarding the use of the Linkyfix Services.

13.2. Partial Invalidity If any provision of these Terms is found invalid by a court, the remaining provisions shall remain valid and enforceable.

13.3. Waiver Our failure to exercise a right or to enforce a provision of these Terms does not constitute a waiver of that right or provision.

13.4. Assignment You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to an affiliate or in the context of a merger, acquisition, or other reorganization.
